Whether we agree with all of them or not, as Somersett Owners Association (SOA) members, there is a set of Association Rules and Regulations we must all adhere to or risk the consequences of their enforcement.  The Association document defining such (i.e., SOA Rules and Regulations Document RES#SOME.0009.07) was updated effective June 1, 2015, and may be accessed by clicking on the following link:

The above document covers a wide variety of topics including: Holiday Decorations, Garage Sales, Parking, Signs & Flags, Vehicle Operations, Landscaping, Fencing, Animals, Business Activities and an Aesthetic Guideline Summary. Violation and Collection Policies are also covered.

To preclude any future problems, if you have not already done so,  homeowners are encouraged to familiarize themselves with the above document as well as the SOA Compliance Policy previously posted on August 18th.

    Association Rules and Regulations is one of the governing documents of our Association.

    Nevada state law (NRS 116.12065) says: “If any change is made to the governing documents of an association, the secretary or other officer specified in the bylaws of the association, SHALL, WITHIN 30 DAYS after the change is made, prepare and cause to be hand-delivered or sent by pre-paid United States mail to the mailing address of each unit or to another mailing address designated in writing by the unit’s owner, A COPY OF THE CHANGE THAT WAS MADE.” (emphasis added)

    “Another mailing address” is a different postal address that some owners might use to get their mail other than their lot address, e.g. out-of-state owners. It is not an email address as emailing was not the fashion or intent when the statue was added to NRS in 1999.

    Simply letting owners know that changes have been made does not meet the legal requirement that a copy of the actual changes be sent out. The law does not care about mailing costs to the Association for complying. Mailing costs are the excuse boards try to use for not complying.

    In February 2009 the community manager for the Association actually sent out a letter to association members ((significant portions quoted here) saying “The revised guidelines, although reduced from their original 99 pages down to some 86 pages, are still far too cost prohibitive to reproduce and send to each and every member of the association. Therefore, in order to save the association considerable expense, the Aesthetic Guidelines Revision 02/19/09 are posted on your association website. If you need a hard copy of the new guidelines, please contact the associations office.”

    Does that wording/action follow the law? Indeed not!

    Note the grammatical error “Revision are.” Should be “Revision is”

    Why does our Association continue to violate the law time after time? Oh, I know, laws and rules are for others to follow, not “me.”

    Didn’t the last lawsuit teach the Board anything?

      Joe, I agree with you this board of directors is as bad or worse than the last. They think they can do whatever they want and no one is going to challenge them. When anyone tries to have them follow the law they are branded as the bad guy. The residents of Somersett need to look in the mirror and ask themselves if they are part of the problem. Many residents do not want to get invested in the community and go with the flow. This causes a minority of the home owners to set the direction of the association. Being apathetic and not getting involved does not do anyone any good. Keep up the good work Joe.
